Many conservatees lack proper financials that allow them to provide for all of their needs on their own. Once a case arrives at the public conservator's office, the public conservatorship investigator should be mindful of the conservatee's assets. Most conservatees under the care of the PC will have medical or are eligible for medical. If the conservate's income falls below a certain range usually 1300 a month, they can be deemed eligible for medical.
For many conservatees they are also eligible for SSI. SSI is a program for the low income individuals who are disabled and cannot find SGA, sustained gainful employment or activity. This means that they are unable to hold a job that pays a regular income with a minimum of 1,200 a month.
Applying for social security is difficult and has an entire branch of law dedicated to helping people fight and win their SSI case. In order to open a case, an individual must open a case and file a claim that they are disabled. In the case of normal people, they may go to the social security office and file a case with case worker. The person will be then given lots of paperwork that will outline the nature of their illness or disability. They must make a claim stating when they think they became disabled, They outline their medical history from all doctor appointments and hospitalizations. They document all of their diagnosis and when they received them. If possible obtaining all of their records can help with the claim. The waiting time for SSI is quite long with some individuals waiting up to a year or two for their claim to be approved.
Once the claim is approved the individual is granted a set amount of a money per month that was calculated based on their income and assets. The letter stating that their claim was approved will state whether their disability was fully favorable or partially favorable. If it is found to be fully favorable that means that the judge agreed with the date of onset of disability. If the letter states that the disability was found to be partially favorable, then that means the judge believes that the disability began at a different date.
Once the case is approved the SSA will award a lump sum payment for the dates that the person was waiting for SSI. This backpay accounts for the date from when the SSA decides that you were disabled to when the claim was approved. There is an exception that the SSA has a five month period from the date of onset in which the applicant will not receive payment. Take for example if the person's disability occurs in January 2018, SSA would not begin to count payments until May 2018. The person is often told that they have 6 months to spend their SSI backpay before it is counted as income. In California the person may receive 750 maximum in SSI as of 2018. If eligible, the person may receive an extra state addition to the 730 bringing the total amount to 910.
If the person is under a LPS conservatorship or unable to manage their money in a proper manner a rep payee may be assigned to their case. A rep payee is a person who is assigned by the SSA to manage incompetent person's finances because they lack the ability to do so themselves. A rep payee distributes the funds to the conservatee on a set basis.
