Serving as Private lps conservator

Only the investigating officer or another county officer or employee designated by the county can act as a temporary LPS conservator. Welf & I C §5352. However, for permanent conservatorship, family members can generally serve as conservator. There are many considerations as to whether family members wish to deal with all of the paperwork involved. This is a question best suited for your county's specific public conservator/guardian. Potential members wishing to serve as conservator shall submit their request to the public conservator for consideration. The public conservator/guardian will run background checks to ensure that there are no conflicts. Additionally, in some counties if the proposed conservatee objects, the public guardian will not allow them to serve as conservator.

If appointed as conservator, the family member must present their letters of LPS conservatorship and order whenever authorizing treatment or signing a contract on behalf of the conservatee.

If at any point the relative wishes to relieve themselves of role as conservator, the public conservator/guardian will take over. It takes around 10 court days for the change to be made.

The person recommended to serve as LPS conservator must notify the conservatorship investigator whether he or she will accept the position. If the person recommended declines to serve, the conservatorship investigator must promptly recommend another person
