Proper Conservatorship Investigation Report

In order to properly prepare a report for court, several factors must be in place. If these factors are not in place, counsel for public conservator will have a harder time arguing the case for conservatorship.. The basic template for most counties involves a section that asks for a detailed outline of why the conservatee is gravely disabled, diagnosis, and basic identifying information about the report [date, location, doctor, and patient info].

The most important part of the report is the section detailing the patient's historical and present course of illness. As seen in the forms gathered from Santa Clara, it asks for specific details about the conservatee's signs and qualifers for grave disability. The first line asks for information and SPECIFICS about how does the conservatee manifest inability to care for food, clothing, and shelter. For providers this is an ideal place to note behaviours past and present that indicated failure to provide. The more information the better.  A common pitfall of doctors is to briefly state generalizations such as patient does not eat enough or cannot provide find a home. to live in. Commonly I tend to see one or two lines about the grave disability. Very little unique information is provided. thus falling short of providing enough evidence to satisfy the high burden of proof [proof beyond a reasonable doubt]. The sample provided above seems like it would suffice preponderance of evidence NOT proof beyond a reasonable doubt.

Another aspect especially if the public conservator is serving as conservator of the person is the treatment plan if a conservatorship is initiated. The plan is to detail the problem symptoms, the end goal, and how that goal will be reached. This can include many modalities such as 
medication administered, treatment facility where the conservatee will reside, and psychosocial treatment modalities.

There are some terrible counties that will lean to conservatorship no matter what is submitted into evidence [san bernardino]



A good example that has been circulated in several places is a report crafted by NAMI guiding loved ones in creating a report to add as an addendum to the petition.
