Review of the trial court's use of evidence on appeal
The abuse of discretion standard is not a unified standard; the deference afforded to the trial court varies according to the aspect of ruling subject to review. A trial court's findings of fact are reviewed for substantial evidence, conclusions of law are reviewed de novo, and the trial court's application of the law to the facts is evaluated under the arbitrary and capricious standard which is the most deferential.
