LPS CONSERVATORSHIP PROCEEDINGS

When a patient begins their 14 day hold, their doctor may consider filing for what is known as a temporary conservatorship.  During a temporary conservatorship, the Public Conservator will serve as LPS conservator until the permanent conservatorship hearing.  

In order to initiate a LPS conservatorship, the attending psychiatrist must file a report to the Public Conservator petitioning for an LPS conservatorship.  His report will detail the patient's medical history and symptoms.  The doctor must prove why the patient is gravely disabled and what manifestations of grave disability the patient shows.  He will also recommend what powers should be suspended.  

Once he files with the Public Conservator, in about a weeks time, they will send a investigator who will question the patient directly about their history and plan of self care.  The court investigator will go the hospital or facility where the patient resides.  They will give the patient paperwork informing the patient that they are being considered for a temporary conservatorship.

If the court investigator decides that the patient is gravely disabled and may need a conservatorship, they will file for a temporary conservatorship with the court.
  

Temporary conservatorship- T-con

If the doctor files and the Public Conservator rules for conservatorship, they will initiate a temporary conservatorship until the permanent conservatorship hearing.  The temporary conservatorship will last for a month.  The permanent conservatorship hearing date will be set and  sent to the conservatee in their letters of conservatorship and citation for conservatorship.  During this the time the public conservator will serve as the LPS conservator.  They have the same powers as a permanent conservator.  
 
  • The right to vote
  • The right to make medical decisions unrelated to grave disability
  • The right to possess a driver’s license
  • The right to enter contracts 
  • The right to own firearms

At this time, the public conservator may ask if you want to serve as the private LPS conservator.  If you do, they will inform you of the steps that you need to do.  You will need to fill out many forms and file with the court.  Depending on your local court rules, you will need to file within a certain number of days or your hearing will be continued.  You will need to file your letters of conservatorship, order appointing permanent conservator, petition for appointment of permanent conservator, agreement to serve as LPS conservator, and (depending on your county) a seven point letter asking for powers.
